Holman J rules Gove's BSF decision was 'unlawful'

Comment

A good case for the Government to lose; "failure to consult" is a hollow victory for the claimants - Gove can easily consult and take essentially the same decision again, and the absurdly lavish multiplicity of representation means this case can be cited the next time the Chairman of the Bar moans about cuts in public funding for lawyers. I see the Brick Court duo were instructed by KCC's "Legal and Democratic Services" - it may be legal to spend public money in this way, but I doubt if there is any democratic support for separate representation of parties who have no conceivable conflict of interest between them.
