The football creditors rule also prioritises debts to other football clubs e.g. for outstanding transfer fees. What is puzzling is not the rule, nor why the clubs should not see it as in their interests, but what possessed any court to endorse it. Effectively the clubs are writing the law to suit themselves. It is simply false to assert that the League and FA need to re-examine the rule. The League and FA can make up whatever rules they like. What is required is that the courts re-assert their authority over the law and stop enforcing this illegal rule. Failing that, the remedy is for the law to be changed by the appropriate body i.e. parliament. Unless that is there is a basis in European Law for the rule. Given German attitudes to taxation, this appears unlikely. One might be forgiven for the fantasy that HMRC has access to legislative processes.
