The arguments advanced may be relatively strong in the context of legal services for individuals/small business but seem to be much less persuasive in relation to large-scale cross-border commercial disputes. The new handbook does ban referral fees but it does not ban barristers from receiving referrals from bodies with which the barrister has material commerical interest (see rule rC82). The LSB’s decision notice on the code highlighted this issue. So all referral fees are banned except when they are a material commercial interest or something.
