It has been an interesting year for intermediaries (such as website operators, search engines and hosting providers) in terms of their potential liability for defamation and for breaches of data protection law. While the Regulations that will implement the newly enacted s5 defence under the Defamation Act 2013 are a complex box-ticking exercise, they do add to the growing arsenal of defences at the disposal of intermediaries.
