Electricity
The Curtis Electricity practice offers comprehensive legal services to the electricity sector from a global platform. Our attorneys represent sponsors, utilities, independent power producers, governments and financial institutions regarding a wide variety of electric generation and transmission operations.
In the generation field, we have extensive experience in both traditional and renewable energy technologies. In the transmission field, we have worked on a variety of financing and regulatory matters ranging from generation interconnection facilities to long-distance transmission lines subject to Federal Energy Regulatory Commission (FERC) Open Access tariffs. Our experience spans matters in several US states and numerous countries worldwide.
We provide comprehensive project development, regulatory, financing, commercial (such as construction and fuel supply), dispute resolution and regulatory advisory services to power industry participants. Our attorneys have worked on projects valued in the billions of dollars and have extensive experience in structuring complex project financings. Many of these financings attract limited or non-recourse capital and, in the US, utilise sophisticated tax-advantaged structures to make use of targeted tax credits, accelerated depreciation and investment tax credits.
In addition to advising on electric energy projects, we also represent clients with respect to contracts for the marketing, sale and transmission of electricity, including procurements for bulk power sales/purchases.
The range of services provided by the group includes:
- Planning, development and distribution
- Public-private partnerships
- Negotiating power purchase arrangements
- EPC contracts
- Fuel supply agreements
- Structuring complex joint ventures for new projects
- Restructuring or acquiring existing projects
- Financing and refinancing power projects
- Procurement
- Concessions
- Tax-exempt debt, tax credits and tax-advantaged financings
Multidisciplinary teams that combine professionals from our other practice areas, including finance, infrastructure development, mergers and acquisitions, environmental and international arbitration, collaborate to provide our clients with worldwide reach and services from offices in the world’s major financial centres in the US, Latin America, Europe, the Middle East and Asia.
