OFT stands firm on anticompetitive silk system

The Office of Fair Trading has reaffirmed its position condemning the QC system as distorting competition and not being in the best interests of consumers.

The announcement has been made in response to the Lord Chancellor, Lord Falconer’s consultation on the future of the silk system.

The OFT questions whether it is right that the government can confer a title on certain counsel which increases their earning power and competitive position.

It also challenges the concept that the silk quality mark really benefits consumers as appointments are made on the basis of their advocacy skills but does not account for their ability to provide legal advice, case management, litigation, negotiation and client care.
