  • It is important to understand that this article represents a dynamic legal issue, not a concluded case. Since the publishing of this information, much has changed and, overall, the tide has turned in the conflict between these two parties.
    The Court of Appeal has found that there was no contempt of Court and therefore no basis for the earlier Court Order of suspended imprisonment. Russell Brown's side was ordered to pay to Mr. Lehman the costs incurred by him in bringing the appeal.
    In this judgment, delivered on March 13th 2013, the Court also dismissed the claim by Russell Brown's holding company, Effiscient Ltd., for damages of US$716,055 for alleged defamation and trademark infringement and upheld an award to Mr. Lehman of the sum of US$1.4million as compensation for the 50% shareholding held in LehmanBrown Limited.
    Consequent to the tempestuous nature of this case and in accord with the latest rulings of Mainland China Courts, Russell Brown has been removed from his position as Treasurer of the Rotary Club of Beijing. Also, the Consultancy, of which Russell Brown is the Legal Representative, has been removed from multiple locations online including LinkedIn, the directory of “Approved Employers” for the Association of Chartered Certified Accountants (ACCA), and various links associated with the Institute of Chartered Accountants in England and Wales
