Like many at Blackstone Chambers, the very versatile Pushpinder Saini QC’s public law practice bridges both the public and commercial spheres, but it is for his commercial work in the ongoing Madoff litigation that this year he is part of the Hot 100.
Acting with New York lawyers for Irving Picard, court appointed trustee of the Bernard Madoff Investment Securities liquidation, Saini has been leading counsel in a substantial number of multi-jurisdictional disputes covering issues of EU law, cross-border insolvency, US bankruptcy law, tracing claims and trusts law seeking to recover part of the US$50 billion which was lost under the Madoff Ponzi Scheme.
This retainer has led to a visit to the Supreme Court leading the Madoff intervention in the case of Rubin v Eurofinance concerning whether overseas insolvency orders can be enforced automatically under the common law and the recognition of foreign bankruptcy trustees in the various jurisdictions.
In June the High Court will examine the relationship between the New York operations of Madoff and Madoff Securities International Limited, a UK-incorporated entity.
Another notable case from 2012 was acting for interested party the Producers Alliance for Cinema and Television at the Court of Appeal in British Telecom and TalkTalk’s bid to challenge the implementation of the Digital Economy Act.
