MCKENNA & Co's environmental team has won a year-long contract from the European Commission for work expected to contribute to a future EC environmental
The job is to undertake a study of member states' law and relates to the 1992 EC Green Paper on 'Civil liability for remedying environmental damage'.
The study is thought likely to underpin forthcoming EC proposals for reviving a wide-ranging directive imposing liability for environmental damage.
A previous EC directive for strict liability caused by waste triggered fearful speculation among industry several years ago but was then shelved.
Pamela Castle, McKennas' head of environmental law, won the contract for the firm against "stiff competition" from throughout the EC member states. Castle says the work involves "carrying out a comparative analysis of the existing systems for liability for environmental damage in each member state of the European Union, the EFTA countries and the US".
Castle says: "The work will involve co-ordinating reports from many jurisdictions with a view to supporting the policy being developed in this area by the European Commission."
The study aims to see whether harmonisation of member states' environmental law is possible, given the great diversity of law among them.
