Matrix to argue both sides of rail battle

Matrix Chambers, Norton Rose and Richards Butler will steam into court later this year to fight over access rights to the East Coast Main Line.

Richards Butler litigation head Belinda Paisley has issued judicial review proceedings on behalf of the Great North Eastern Railway (GNER) against the Office of Rail Regulation (ORR).

GNER claims that the ORR’s decision to allow the Grand Central Railway Company (GCR) to operate services on the East Coast Main Line is discriminatory, an unlawful grant of state aid, a distortion of competition and is against European and national law.

Paisley has instructed Rabinder Singh QC of Matrix for GNER. Norton Rose partner Sam Eastwood has instructed Rhodri Thompson QC, also of Matrix, for the ORR.

The ORR said it will contest the proceedings, which will reach court in July if an expedition application is granted.
