Amec Properties of Northwich has launched a High Court action against Spitalfields of Douglas, Isle of Man. It seeks a declaration that it is entitled to access and use of light through windows of property at 3, 4, and 5 Stewart Street, London E1, an order cancelling registration as a land charge of the purported light obstruction notice and damages. Spitalfields is alleged to own property at 46-50 Gun Street, and 6 and 6a Stewart Street, London E1, and on 28 January last year served a copy of a proposed application for registration of a light obstruction notice. The writ alleges that the application wrongly depicted the extent of Amec's land, that Amec's windows have been in their current position for more than 19 years and that Amec enjoys rights of light by virtue of the doctrine of lost modern grant, or by s3 of the Prescription Act 1832.
