Noise in the underground
The rights of councils in London to police noise from the underground rail network are on trial in the High Court. In 1996 the London Borough of Camden issued an abatement notice under the provisions of the Environmental Protection Act 1990 after receiving noise complaints from the owner of a flat adjacent to Russell Square Station. The resident claimed that he was constantly disturbed by the noise from the station's lift motor room which was separated from his living room by a party wall. The stipendiary magistrate ruled that the abatement notice was defective. The council is challenging the magistrate's ruling that they mishandled moves to curb the noise from the station's lifts. The High Court has reserved judgment on the case.
