The Secretary of State for Social Security Peter Lilley is to ask the Law Lords for the right to be joined in a legal battle over housing benefits. The case of R v Rent Officer and others ex parte Muldoon, centres on allegations that Liverpool City Council failed to determine claims and pay appropriate housing benefit. The Secretary of State has so far failed to win the right to be joined in the action both in the High Court and Appeal Court. But now the House of Lords has granted leave for another challenge. The Secretary of State argues that he is entitled to be joined as he was a "directly affected" person and should have been served with notice of the proceedings.
