Law Commission's consultation paper on rights to light
Rights to light continue to have a major, perhaps disproportionate, impact on the property industry and property development particularly in urban centres. There are serious concerns about perceived uncertainties in the law, which it is argued have an adverse impact on the economy through preventing developments and all the benefits that they bring. The controversial High Court decision in Heaney, in particular, caused the government to focus on perceived problems with rights to light. The result is the Law Commission’s consultation paper on rights to light.
