Acas has published new non-statutory guidance to accompany the introduction of its new statutory code of practice on settlement agreements, which came into force on 29 July 2013.

The new guidance sets out good practice and has no formal status in employment tribunal proceedings. However, it is designed to help employers and employees understand what settlement agreements are, what their effect is, when they might best be used and how they can be negotiated. The guidance includes checklists for employers and employees, a model settlement agreement, template offer letters and some examples of how settlement agreements might be used.
