After nearly two years of waiting, the new utilities procurement directives are close to being adopted: the European Commission now expects them to enter into force in December this year or early next.
With this will come a raft of changes such as: clarification of which entities are utilities; updating the rules on exemptions for utilities operating in competitive market; codification of the current case law on material changes to contracts; importation of public sector rules such as the competitive dialogue procedure; and regulation of works and services concessions.
