The UK Intellectual property Office (UKIPO) has upheld an opposition by Georgio Armani against Jacob Armani’s application to register a figurative mark for baby equipment. Armani opposed the applicant’s mark on the grounds that (i) there existed a likelihood of confusion between its marks and the applicant’s mark and (ii) the applicant’s mark would take unfair advantage and cause detriment to the distinctive character or repute of the Armani marks. Armani also relied on its Armani mark being a well-known trademark.
While the hearing officer did not consider there would be direct confusion between the applicant’s mark and Armani’s mark, he stressed that the fact the marks contained the unusual Armani name could cause consumers to believe the goods offered under the marks were from the same undertakings or economically linked undertakings…
