TUPE reform has long been part of the government’s proposals to cut red tape, ease the regulatory burden on businesses and remove UK provisions that go further than required by Europe (so-called ‘gold-plating’ of European directives when they are implemented into domestic legislation).
Following two years of formulation, we now have the draft TUPE revisions to be brought in force early in 2014. Initially, the government indicated extensive changes were on the way in its crusade against perceived ‘gold-plating’. While the regulations will remove some unnecessary gold-plating, the overall effect is significantly less radical than the original proposals. It all amounts to more of a TUPE ‘regeneration’, rather than ‘extermination’ for gold-plating…
