Laura Daniels has gained experience across the spectrum of employment disputes beyond that usually seen at her level of call.
She is regularly instructed by both claimants and respondents, including multi-national corporations, NHS trusts, unions and professional bodies such as the BMA. She often represents parties in multi-day cases, having appeared in an eight-day hearing involving disability discrimination and constructive unfair dismissal as well as numerous three-, four- and five-day cases involving matters such as TUPE, whistleblowing, unfair dismissal, pregnancy and race discrimination and multiparty claims. She is equally at home appearing in preliminary hearings and one- or two-day cases.
Her practice covers all tribunals in the UK and she regularly appears in the Scottish tribunals.
Daniels has appeared in the Employment Appeal Tribunal in cases involving, among other things, the application and interpretation of the insolvency provisions within TUPE, sexual harassment and the interrelationship between Polkey and constructive dismissal. Additionally, she has advised in respect of a matter referred to the European Court of Justice.
Daniels’ practice encompasses civil/commercial employment disputes, having successfully defended claims for breach of restrictive covenant, the tort of conspiracy, conversion, knowing receipt, misuse of confidential information, breach of contract and inducement to breach of contract and inducement to misuse confidential information. She has also appeared in COT3 enforcement proceedings in the county court. Daniels is experienced in civil discrimination disputes, having successfully defended claims on behalf of both education providers and property management agents in the county court.
