The Bermuda Court of Appeal held that statements in relation to assistance at common law to foreign officeholders made in an earlier Privy Council decision were not binding on it.
Consequently, the Bermuda courts could not assist foreign liquidators where the company was not in an ancillary liquidation and where domestic provisions would not permit such assistance.
