Incident: Medical negligence

Injuries: Claimant suffered acute cerebral palsy as result of oxygen starvation at birth at Chase Farm Hospital, Enfield, in December 1978. He is now said to have an active and intelligent mind which is trapped in a desperately handicapped body, is unable to do virtually anything for himself and is totally dependent on the care of others. He cannot speak, has no use of his limbs and was described in court by his mother as being like a "rag doll" Award: Case settled on basis of 90 per cent liability. Jacobs v Courtauld Textiles Ltd – QBD, 28 October 1996

Claimant:Olivine Jacobs, Incident: Injury at work

Injuries: Claimant suffered neck pain as result of five years work stooping over workbench at factory where she worked as garment examiner. The judge found that the defendant had failed to improve the working posture of the mother of five, but her pain was largely due to degenerative changes in her spine brought on by age and a common spinal condition in no way connected to her job. But he held that the defendant had failed to take adequate steps to improve claimant's working posture after it became aware of her back problems and awarded damages on that basis
