Tenant Cadogan Properties is seeking a declaration that landlord Mount Eden Properties of Guernsey has unreasonably withheld consent to sub-let the property. Both came under judicial fire in a skirmish which reached the Court of Appeal. Mount Eden appealed against the refusal of the High Court to strike out Cadogan's action on the basis that papers were wrongly served outside England and Wales. The Court of Appeal agreed that the papers had not been correctly served. However, Lord Justice Waller was critical of both sides in the case. He accused Cadogan of failing to comply with legal rules and Mount Eden of pursuing a "technical course" without any real purpose other than to teach Cadogan a lesson.
