Media boutique Wiggin has -crippled pirate CD importers CD WOW after winning £41m in -damages in the High Court for UK record industry group the British -Phonographic Industry (BPI). CD WOW is based in Hong Kong and sells CDs to the UK -market, a -practice which breaks UK IP rules on -parallel importing. –Clifford Chance‘s Hong Kong office secured a Mareva order to freeze CD WOW’s assets. The High Court -calculated the £41m -damages amount by considering the cost to the music industry of the 12 -million CDs that were sold -illegally in the UK over the past three years. Wiggin partner Simon Baggs acted for the BPI, instructing barristers Richard Spearman QC of 4-5 Grays Inn Square and Mark Vanhegan of 11 South Square. CD WOW was -represented by partner Nigel Davies at K&L Gates, who instructed Philip Roberts at One Essex Court.
