Model Marjan Debevere is suing hairdressing chain Toni & Guy in the High Court for more than #50,000. She accuses the hairdressers of using her photograph in advertisements without her permission. Debevere says in her claim that she modelled for the company between December 1993 and January 1995 but that she only agreed to her picture being used editorially in magazines and not commercially. She alleges that Dorking-based Marcolo, which owns Toni & Guy, breached her contracts by using the photographs and a video in its yearbooks, on bags sold in Japan and for advertising. Pictures of her are also said to have appeared on T-shirts, on diplomas awarded to students of the company's training academies and on leaflets. She claims she was paid fees ranging from #35 an hour to #250 a day for the photo sessions and that the company was well aware that the photographs and video were intended for editorial use only, which attracts the lowest fee. Her claim says that the pictures used on the nylon bags sold in Japan alone should have earned her a fee of #3,000. In addition to seeking damages she is also seeking a court order banning the company from further alleged breaches.
