Nigel Adams & Co, a one-partner London practice, is to represent the controversial historian David Irving in his oral application for leave to appeal, following his libel defeat against Professor Deborah Lipstadt and Penguin Books in the High Court last year.`In the original case, Irving represented himself. James Libson at Mishcon de Reya is advising Lipstadt, while Davenport Lyons is advising Penguin. Mr Justice Gray originally refused to grant leave to appeal and Irving’s paper application was turned down by Lord Justice Sedley. Irving now claims to have new evidence, and the grounds for the appeal concern the gas chambers in Auschwitz. Libson told The Lawyer: “This evidence was available at the time of the original trial.” Nigel Adams declined to comment.
