A High Court ruling that notices given under break clauses in respect of two leased properties in Northampton were valid, is to be challenged in the Court of Appeal. The case will centre on the status of successors to tenants when it comes to using break clauses. In May last year, Mr Justice Rattee ruled in the case of Lemmerbell and anor v Britannia Las Direct that the notices given in respect of property in Northampton were valid, despite arguments from the landlords that they were not. Now the landlords are appealing against that decision.
