The Law Lords have given leave for appeals on behalf of victims and relatives of victims of the Indian Airlines Airbus crash at Bangalore, India, in 1990 in respect of a dispute over where the claims should be heard. In April last year the Commercial Court dismissed an application by Airbus Industrie to confine the litigation to India. However, in July the Court of Appeal allowed an appeal against that decision and granted an injunction confining it to India or France. Now the House of Lords is being asked to overrule that decision. Claims have been mounted in Texas, and the Texas Court of Appeals in September last year held that Airbus Industrie was not immune from suit there.
