Judgment from Mr Justice Carnwath is now pending in a major battle over classification of imported waste materials. Waste recycling company Dockgrange, which is based in Kent, claims that its business has been "devastated" because of an Environment Agency decision to upgrade the procedures necessary for handling waste it imports from Europe. Dockgrange accuses the agency of misinterpreting EC regulation 259/93. It alleges that the interpretation of the regulation is misconceived, irrational, absurd and that it defies common sense.
