Two soldiers, one from Nottingham and the other from the Isle of Wight,who claim they
have been injured after their medical conditions were notproperly diagnosed, are suing
the Ministry of Defence for compensation.Dean Cumberpatch, 27, of Skegby,
Sutton-in-Ashford, Nottingham, and DarrenLambert, also 27, of East Cowes, Isle of Wight,
accuse the MoD ofnegligence, breach of contract, breach of duty and breach of the
EuropeanConvention on Human Rights. They allege failure on the part of the MoD
toproperly diagnose and treat them when they were in the army, and complainof the
medical and psychiatric treatment made available to them. The claimsadditionally seek
damages for alleged trespass to the person, unlawfuldetention and false imprisonment.

MichaelCullen, 68, who is suing through his wife and next friend, ElizabethCullen,
accuses the trust of breach of covenant in allegedly failing tomaintain and repair the
steps which are claimed to have been cracked anduneven, and failing to keep a guarding
wall beyond which there was a dropof 3.3 metres in good repair. Cullen lost his balance
and fell over thewall as he walked up the steps on 7 January 1996. He suffered a
fracturedskull, went into a coma and was in hospital for six months. The claim saysthat
the injuries have had a devastating effect on him and that he is nowunemployable and

Trust ofDenbighshire is suing the trust. Roger Thorne claims he was employed undera 1997
contract with the Mid Glamorgan NHS Trust which later transferredits powers and
interests to the Welsh Ambulance Trust. He says the contractwas originally intended to
run to March 2000. He says that in October 1998he was told that unless he accepted an
alternative post his employmentwould be terminated on the grounds of redundancy. He did
not accept thepost and says he was made redundant. He claims the trust acted in breach
ofcontract and that he has wrongfully been deprived of benefits to which hewas entitled
