The SFO is under attack again following the decision of Mr Justice Buckley in the High Court last week to dismiss the second trial of Kevin Maxwell and three other defendants. In the judgment, the judge criticised the prosecuting authorities. Maxwell's solicitor, Peters & Peters partner Keith Oliver, said the judge had considered the issue of overall fairness, and if the prosecution had continued, it was clearly an indication that the authorities did not accept the jury's verdict at the first trial. Oliver complimented the judge on the “careful and considered way he analysed the issues, and the common sense approach he adopted”.
