Mishcon de Reya has scored a rare criminal conviction from an IP case, securing a jail sentence on behalf of Microsoft against a parallel importer.
The decision marks the end of an IP litigation that started five years ago, when Microsoft first took action against Itac, a company run by Barry Omesuh.
Mishcons contentious IP head Jeremy Hertzog, along with associate Adam Morallee, have been running the case for Microsoft.
In 2006 the High Court ordered ;Itac ;to ;pay Microsoft £1m. Two years later Microsoft obtained freezing and search orders against Omesuh, who was found to be in contempt of court.
Last week the High Court gave Omesuh seven prison sentences, all between one and ;nine ;months ;in duration.
Microsoft UK anti-piracy lawyer Graham Arthur said: “We want to make sure that retailers caught cheating the system are held accountable for their damaging actions.”
