The House of Lords is currently considering whether to entertain an appeal by smoking rebel Peter Boddington against his conviction of smoking on non-smoking trains. Boddington was convicted by magistrates in Essex in July 1995 of smoking in breach of bylaws and was fined £10. That conviction was upheld by the High Court in July last year. Now he is seeking leave to appeal to the House of Lords, but the matter has been adjourned to give British Transport Police an opportunity to lodge objections against the move.
