Charles Edward Nutter, 42, admitted 1984, practised as Charles Nutter & Co, Blackpool (address given as Puerto Pollensa, Mallorca at time of tribunal hearing), struck off and ordered to pay £4,451 costs. Allegations substantiated he failed to maintain properly written accounts, failed to produce accounting documents for inspection when required, drew money from client account contrary to rules. Tribunal said Nutter's accounting and his misuse of client funds was "entirely unacceptable".
John Kenneth Hyland, admitted 1975, practised as Hylands, of Biddulph, Stoke on Trent, struck off and ordered to pay £990 costs. Allegations substantiated he used client money for purposes of other client and himself, failed to disclose information material on a transaction to a client, wrongly drew client money, failed to keep properly written accounts. Compensation Fund said to have received 80 applications totalling over £53,000. Hyland previously before tribunal in 1982 when he was fined £250.
Sylvia Harvey (formerly Carr), solicitor's clerk, latterly worked in conveyancing field for Messrs Jeffries & Co, of Deansgate, Manchester, banned from working for any further solicitors without written consent from Law Society. Allegations substantiated she pleaded guilty at Liverpool Crown Court in June 1993 to two counts of attempting to procure execution of a valuable security by deception and sentenced to four months prison.
James Kieran Fielding, admitted 1981, practised under own name in Liverpool, fined £1,250 and ordered to pay £1,468 costs. Allegations substantiated he failed to pay counsel's fees when due and failed to reply to correspondence from Complaints Bureau.
Robert Michael Salmon, 47, admitted 1974, practised in partnership with Hobson & Arditti, London WC1, struck off and ordered to pay £3,276 costs. Allegations substantiated he made or caused false entries in accounts books, failed to maintain account books in accordance with rules, wrongly drew client account money. Tribunal told it was thought his activities would lead to claims against the Solicitors Indemnity Fund in the region of £250,000. Tribunal said Salmon appeared guilty of "wholesale raiding of client account" to keep his firm afloat.
Kenneth William Westgarth, 52, admitted 1970, practised in partnership as Cooksey Spencer Westgarth, Coventry, fined £2,000 and ordered to pay £895 costs. Allegations substantiated he was guilty of unreasonable delay in professional conduct, failed to reply to letters from Complaints Bureau, failed wholly or in part to comply with resolution of conduct committee of Adjudication and Appeals Committee.
