The way has been paved for the House of Lords to probe the insurance position of Kuwaiti-owned aircraft and equipment damaged during the Iraqi invasion of the country. The Kuwait government and the national airline, the Kuwait Airways Corporation, launched action against Kuwait Insurance after 15 aircraft, spares and equipment were damaged during the invasion. In December 1995, Mr Justice Rix dismissed the airline's bid to sue for more than US$300m in losses. An appeal by the airline and the government was dismissed by the Court of Appeal in May this year. They have now been granted an appeal to the House of Lords against those decisions.
