Conveyancing solicitors should be restricted in acting for both building societies and borrowers, the Law Society will be proposing later this month. The Law Society Council last week resolved to consult the profession on amending its regulations so that joint representation of borrower and lender will only be permitted where the instructions for the lender are confined to ensuring good title, or are approved by the council. Vice-president Phillip Sycamore said the proportion of claims on the Solicitors Indemnity Fund fund by lenders had grown from 60 per cent two years ago to 70 per cent last year, and the rule change was intended to prevent lenders claiming on "our fund" for their mistakes.
