The Law Lords are considering whether to give leave for an appeal by husband and wife Lee and Kathleen Montgomery, who were made the subject of a restraint order imposed at the request of the US. The case raises the question of whether the UK courts have the jurisdiction to make such an order. The order under challenge was made by Bow Street Magistrates Court in September 1997. However, the High Court allowed an appeal against it in February 1998, but that decision was reversed by the Court of Appeal in July 1998.
