Addleshaw Goddard associate Adam Wilson had
the rare pleasure of seeing a case go all the way to
the House of Lords last year, which culminated in
victory. From the case’s beginnings in Bradford
County Court in 2003, Wilson represented building
society Bradford & Bingley in its attempts to
recover losses from the sale of a mortgaged
property.
After a disappointing Court of Appeal decision in
2005, Wilson took it as high as possible. While the
case was small in terms of the disputed debt, it had
serious implications for the ‘without prejudice’
rule. Their Lordships found it hard to agree, but
concluded by a three to two majority that letters
acknowledging the debt were not protected by
the rule.
Wilson is following up the House of Lords success
with a number of high-value fraud claims, ensuring
that his buoyant practice keeps on growing.
