  • It certainly COULD be insured, but it depends on the firm's choices of coverage. Employment Practices Liability (EPL) would cover this alleged act AND the costs to litigate it. Indemnity (what is paid out as a settlement or judgement) would have a policy limit of some kind, but often litigation is covered without limit.
