McNamara, Stephen

Stephen McNamara practises principally in the field of clinical negligence, acting predominantly for claimants.

His cases span the areas of surgical and pharmaceutical negligence, misdiagnosis and delayed diagnosis, dental negligence, inappropriate treatment and failure to obtain informed consent, amongst others.

McNamara is well used to dealing with complex areas of breach of duty and causation and is regularly instructed in high-value cases in which significant future losses are claimed. He is experienced in leading and managing a large team of experts during such cases.

He has particular experience of claims involving suicide arising as the result of negligent psychiatric treatment, including claims advanced under the Human Rights Act 1998.

He regularly attends inquests on behalf of families and other interested parties in such cases and has developed an in-depth knowledge of the application of Article 2 ECHR to inquest proceedings, both in relation to jurisdictional issues and its effect on the scope of inquiry.

McNamara also has considerable experience of cases arising as the result of negligent cosmetic surgery and is adept at dealing with the often difficult medical, legal and emotional issues which such cases involve.

He also practises in the field of personal injury, acting for both claimants and defendants in claims for serious injury arising from accidents in the workplace, on the highway and on private premises, and those caused by defective products and road traffic collisions.
