Kings Chambers’ Richard Clayton succeeds in rents for allotment holders judicial review

Richard Clayton QC, instructed by Alex Peebles at Irwin Mitchell, has succeeded in judicially reviewing the decision of Leeds City Council to double the rents the council charged to allotment holders.

In R (Woods) v Leeds CC [2014] EWHC 2598 (Admin), the Leeds and District Gardeners Federation challenged the council’s decision to raise rents to eliminate the council’s subsidy.

Clayton successfully argued that the council failed to consider any valuation evidence when setting the rent in breach of section 10 of the Allotment Act 1952.
