Insurance and reinsurance law
The lawyers within our Insurance and Reinsurance Law practice advise insurance and reinsurance companies as well as insurance intermediaries, including banks and other professionals of the financial sector, on all regulatory matters relevant to their businesses — both local and cross-border.
This includes licence applications, passporting rules, launching of new insurance products, portfolio transfers, investment rules and service and intermediation agreements. We further handle, in co-operation with our litigation practice area, various cases of insurance law litigation.
We have always maintained good relations with the insurance supervisory authority in Luxembourg in order to ensure that our clients’ matters are dealt with swiftly and efficiently.
Our insurance lawyers have acquired considerable expertise in the mergers and acquisitions activity relating to the insurance and reinsurance businesses, as well as in the liquidation of insurance and reinsurance companies. The practice area has been involved in major restructurings of insurance and reinsurance groups, including acquisition transactions, mergers and business transfers, both domestic and cross-border. Our dedicated team benefits from the experience and expertise required to handle transactions of all sizes.
The team also has extensive knowledge in drafting agency and brokerage agreements, as well as on advising on all aspects of the distribution of insurance products. As such, we act as counsel not only to insurance undertakings but also to insurance intermediaries, as well as banks and other professionals of the financial sector, with respect to their activities as insurance intermediaries.
We provide legal assistance to our clients in relation to the preparation of new products, as well as the drafting of all contractual documentation relating to their insurance and reinsurance activities. We have in particular developed an advanced specialisation in the setting up of the contractual framework for dedicated life insurance policies.
