Eversheds represents Hansa Bygg in construction contract appeal
In December 2013, NCC Construction was awarded the contract in the Municipality of Kalmar’s evaluation of the submitted tenders for the construction of a new fire station in Kalmar. Hansa Bygg, which was ranked second in the evaluation and was represented by Eversheds Stockholm, claimed that NCC Construction’s bid should have been disqualified since it did not comply with all mandatory requirements in the request for tenders.
In a judgment on 18 August 2014, the Administrative Court of Appeal in Jönköping ruled in favour of Hansa Bygg’s appeal (case No 897-14). The court ruled that the municipality must re-evaluate the tenders due to flaws in NCC Construction’s tender.
The construction of the new fire station has a contractual value of approximately SEK70–80m (£6–8m).
