Environmental

Environmental law straddles several of the key areas in which Chambers is already recognised as a leading set. These include transport, health and safety, regulation, personal injury, public and criminal law.

This area of law has grown so fast that it is now properly labelled as an area of specialism for Outer Temple Chambers. Members have been involved in many of the most significant environmental cases of recent, and present, times. Chambers has responded to the demand for high-quality representation in this area with a newly created Transport Team.

The Transport Team is led by Tim Nesbitt and Patrick Sadd, two of the three leading juniors in the UK in this area of work. Both have vast experience of public inquiries called by the transport regulatory authorities to look into environmental issues thrown up by HGV/coach fleet operators. They act both for defence and prosecution in criminal cases against transport operators involving environmental allegations — particularly under the relevant European legislation relating to the road haulage industry. Trial and advisory work also frequently engages issues arising under the Environmental Protection Act 1990, the Water Resources Act 1991, the Environment Act 1995, the Planning (Hazardous Substances) Act 1990 and in relation to the various common law and statutory nuisances relating to noise, smell, smoke and dust. The work is business critical. Nesbitt and Sadd’s reputations are not limited to England and Wales. They are frequently instructed to appear in cases in Scotland and Northern Ireland, as well as by law firms from continental Europe. Because of its close links with the transport industry, they also have a particular interest in the law relating to waste management, disposal and recycling, frequently acting for companies engaged in those activities in the various regulatory regimes that apply to them.
