Fenech & Fenech

  • Overview

The firm: Established in 1891, Fenech & Fenech Advocates has become one of the largest full-service law firms in Malta and is an established leader in all aspects of shipping, aviation, commercial, corporate, tax, mergers and acquisitions, asset finance, financial services, intellectual property, iGaming and ICT law. All of the firm's lawyers are highly specialised in their respective fields, with a number of them being actively involved in the development and amendment of laws related to their areas, and/or lecturing on their subject at the University of Malta, as well as at other fora both in Malta and abroad.

The firm regularly acts for banks and other financial institutions, particularly in the area of corporate, project and asset finance — although it often also assists borrowers in such transactions — and assists in tax-driven structuring of corporations and other vehicles both locally and abroad. Fenech & Fenech has also advised on various M&A transactions involving petrochemical, shipping, aviation, iGaming, ICT and industrial projects among others. The firm has substantial experience in the handling of international maritime matters, and is involved in the majority of shipping casualties taking place in Malta or involving Maltese registered vessels worldwide, thus acting for numerous large ship owners, tug and salvage operators, ship repairers and so on. It is the only law firm on the island with a dedicated marine litigation department. A further mainstay is ship registration and ship finance. This department is one of the largest of its kind in Malta, having been involved in the development of the ship registration industry in Malta since its inception. The firm also has a fully fledged tax department, one of the longest established locally, servicing a predominantly international clientele across the full spectrum of immigration and tax issues. Notably, the firm is one of the only law firms on the Island having expertise in aviation law and aircraft lease and finance and is retained, among others, by the national airline. The firm was the first on the island to set up a specialised ICT Law practice and is very active in the field, ranging from software contracting, outsourcing, e-commerce, gaming law and internet law. Recently it has also branched out into art and cultural property law as an adjunct to its intellectual property law practice.

Subsidiaries: A corporate services company, a licensed trust and fiduciary company, a ship registration company, as well as a company specialising in assisting clients to access EU funds are among the firm's subsidiaries. Fenlex Corporate Services Limited has its roots in the late 1980s. It was set up to service clients of the firm who required more than legal advice and over the years has developed into a full-service corporate services provider. Today it employs a range of professionals that include accountants, chartered secretaries, management consultants and company administrators and is one of the largest independent CSP's on the island servicing well over 800 structures for a large array of international clients in various sectors. Fenlex provides back office as well as operational assistance. Fenlex Holdings and Services Limited is licensed by the Malta Financial Services Authority to offer trust and fiduciary services as well as to administer foundations. Fenech and Fenech Marine Services is a leading provider of ship registration services and assists clients to register and maintain their vessels on the Malta register. Impetus Europe Consulting Group is a joint venture that Fenlex has entered into with a leading human capital and marketing company in Malta and offers clients consultancy services in EU-related matters focusing on funding of projects, public relations and perception management.
