A drink which has captured 90 per cent of the high-energy drinks market
is at the centre of a pending High Court battle. The makers of Red Bull
have launched proceedings to stop sale of an alcoholic drink called VRB,
one of the nicknames given to Red Bull by drinkers when it is mixed with
vodka. Red Bull Gmbh and Red Bull Co claim that sale by Beverage Brands
(UK) and SHS Sales and Marketing of VRB would confuse the public into
believing it was made by Red Bull. They are seeking injunctions to block
sale of the product and an order that any stocks of the drink should be
handed to them or destroyed along with any other delivery, or destruction
of all articles associated with the proposed sale of VRB. They are
represented in their claim by Laytons.
