The House of Lords is currently considering whether to hear appeals by Philomena Gangadeen, Daniel Jurawan and Khalid Khan against Home Office deportation rulings. The appeals, if allowed, will raise the question of whether, in a case where a decision affects the interests of a child of a prospective deportee, it is incumbent on the Home Secretary to give preference to the best interests of the child as the first consideration in the process. So far the High and Appeal Courts have dismissed applications for judicial review of the deportation decisions.
