A BANKRUPTCY petition against Merseyside solicitor David Deacon has been has been rejected by the court.And now the founder of Liverpool firm Deacon Goldrein Green (DGG) has issued a writ against creditor NWS Trust for malicious presentation of the petition.Deacon, who left in 1992 when the partnership was dissolved, had argued that he was not responsible for the debts run up after his departure.DGG crashed owing millions of pounds last autumn and was officially wound up in January.Eight former equity partners were made personally bankrupt six weeks ago. No petition was filed against Neville Goldrein who was never a partner at DGG.Hearings against Martin Green and Patricia Reynolds, who like Deacon left before the collapse, have been adjourned.At Liverpool County Court last week District Judge Elliott Knopf threw out the case against Deacon and ordered costs against NWS Trust which is understood to be owed u400,000.The petition was supported by Frizzell Banking Services, owed u800,000, and Customs & Excise, owed u400,000.In a statement, Deacon disclosed that counsel had advised the "commencement of legal proceedings" against NWS Trust for malicious presentation of the bankruptcy petition."Accordingly a writ has been issued in Liverpool District Registry in the High Court of Justice," he said.Deacon, who is represented by Wigan sole practitioner Marshall Ronald, declined to add anything to the statement.NWS was unavailable for comment.
