Court of Appeal allows preliminary injunction pending appeal of invalidity

The Court of Appeal has allowed Novartis’s application for a preliminary injunction against Hospira on two patents covering the use of zoledronic acid for osteoporosis that were held invalid in an earlier High Court decision of Arnold J. Arnold J’s decision is subject to an appeal and the injunction will continue until the appeal is heard. The decision overturns the judgment of Birss J last week not to grant the injunction.
