Council seeks leave to appeal

The case of Welton v North Cornwall District Council will continue. Victoria and David Welton set up a holiday accommodation business turning a farm house in north Cornwall into a guest house which won a three crowns rating from the West Country Tourist Board. But they were threatened with closure following a visit from an Environmental Health Officer. They won £39,522 damages on the basis they had been caused economic loss as a result of the negligence of that council officer and the award was upheld by the Court of Appeal. Now the Council is seeking leave to appeal to the House of Lords.
