Convicted murderers appeal

Two convicted murderers are to challenge their convictions in the House of Lords. Graham Carlo Bingham and Samuel David Cooke, convicted by Mr Justice Higgins at Belfast Crown Court on 10 December 1994, have been given leave to appeal on the question of whether the judge was entitled to refuse the cross-examination of a defendant who has been sworn under the Provisions of Article 4 of the Criminal Evidence Order (Northern Ireland) 1988 on the grounds that his counsel had not asked him any questions. The inferences that a court can legitimately draw are also questioned.
